Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the HourQuest mobile application (the “App”), the website at hourquest.org, and related services provided by HourQuest (“HourQuest,” “we,” “our,” or “us”).

By creating an account, accessing, or using the App or website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App or services.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use HourQuest.

If you are under 18 years old, you should use the App only with the permission and supervision of a parent or legal guardian.

By using the App, you represent that you meet these eligibility requirements.

2. Accounts

To access certain features, you may need to create an account.

You agree that:

  • You are responsible for maintaining the confidentiality of your login credentials
  • You are responsible for all activity occurring under your account
  • Information you provide must be accurate and current
  • You will promptly update inaccurate or outdated information

HourQuest may offer authentication through:

  • Email and password
  • Sign in with Apple
  • Google Sign-In

You may permanently delete your account at any time through:

  • Settings → Delete Account

3. Challenges and Verified Hours

As a student or volunteer user, you may:

  • Browse environmental and medical volunteer challenges
  • Complete challenges in your community
  • Upload photo proof of completed challenges
  • Earn verified volunteer hours after review
  • Download certificates at hour milestones
  • View leaderboards and track progress

Feature availability may vary over time.

Regarding verification:

  • Verified hours are calculated using submitted proof and HourQuest review processes
  • Hours may be reviewed, modified, denied, or removed if information is incomplete, inaccurate, fraudulent, or inconsistent
  • You agree not to submit false, misleading, or fabricated proof of challenge completion

Certificates and in-app achievements represent HourQuest verification of completed challenges. They are not official governmental, educational, or professional certifications unless explicitly recognized by a school, organization, or program.

4. Partners and Schools

Schools, clubs, and organizations that partner with HourQuest are responsible for:

  • Accuracy of partnership information they provide
  • Compliance with applicable laws, regulations, and policies
  • Appropriate use of student data shared through partnership features

Partners may not publish misleading, unlawful, harmful, fraudulent, or deceptive content.

HourQuest reserves the right to remove content or suspend accounts that violate these Terms or create risk to users or the platform.

5. Acceptable Use

You agree not to:

  • Violate applicable laws or regulations
  • Infringe the rights of others
  • Harass, abuse, threaten, or harm other users
  • Submit false, misleading, or fraudulent challenge proof or reviews
  • Attempt unauthorized access to accounts, systems, or data
  • Interfere with or disrupt platform functionality
  • Reverse engineer, scrape, or overload the App
  • Use the App for spam, unsolicited promotions, or unauthorized marketing

Violation of these Terms may result in suspension or termination of your account.

6. User Content

You retain ownership of content you submit through the App, including challenge proof photos, profile information, and other submissions.

By submitting content, you grant HourQuest a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and process that content solely for the purpose of operating and improving the App and related services.

You represent and warrant that:

  • You own or have the necessary rights to submit the content
  • Your content does not violate applicable law or these Terms
  • Your content does not infringe the rights of any third party

7. Third-Party Services

HourQuest may integrate with third-party services and providers, including:

  • Apple
  • Google
  • Supabase
  • Notification and hosting services

Your use of third-party services may be governed by their own terms, policies, and practices. HourQuest is not responsible for third-party services or content.

8. Intellectual Property

The App and website, including software, branding, logos, visual design, challenge content, features, and materials (excluding user-generated content), are owned by HourQuest or its licensors and are protected by intellectual property laws.

Except as expressly permitted under these Terms, you may not:

  • Copy
  • Modify
  • Distribute
  • Sell
  • License
  • Reverse engineer
  • Commercially exploit

any portion of the App or website without prior written permission.

9. Disclaimers

THE APP AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOURQUEST DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY OR ACCURACY OF SERVICES.

We do not guarantee:

  • Uninterrupted or error-free operation
  • Acceptance of verified hours by every school, college, or program
  • Specific volunteer outcomes or experiences
  • Availability of any particular challenge

You are solely responsible for safely completing challenges in your community and for complying with local laws and third-party rules while doing so.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOURQUEST AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT WILL HOURQUEST’S TOTAL LIABILITY FOR ANY CLAIM EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO HOURQUEST IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you. In those jurisdictions, liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless HourQuest and its affiliates, officers, employees, contractors, and licensors from and against claims, liabilities, damages, losses, and expenses arising from:

  • Your use of the App
  • Your content
  • Your violation of these Terms
  • Your violation of applicable law or third-party rights

This obligation does not apply to claims resulting from HourQuest’s gross negligence or willful misconduct.

12. Suspension and Termination

HourQuest may suspend or terminate your access to the App at any time if:

  • You violate these Terms
  • Your conduct creates legal or security risk
  • We discontinue the App or related services

You may stop using the App at any time and may permanently delete your account through the App settings.

Sections of these Terms that by their nature should survive termination — including intellectual property provisions, disclaimers, limitation of liability, indemnification, and dispute provisions — will survive termination.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles, except where mandatory local law applies.

Any disputes arising from these Terms or the App will be resolved exclusively in the courts located in North Carolina, USA, unless applicable law requires otherwise.

14. Changes to These Terms

We may revise or update these Terms from time to time.

The “Last Updated” date will also be revised accordingly.

By continuing to use the App after updated Terms become effective, you agree to the revised Terms.
